General
These terms and conditions apply to all sales/transactions with wineandtapas.com .There will be no variation to the terms and conditions, unless agreed via a formal communication method with wineandtapas.com. The placement of an order indicates your acceptance of these terms and conditions. This does not affect any statutory rights you may have. Please take note of all the terms and conditions.

Formation of contract
The products advertised on the wineandtapas.com website site are an invitation to purchase product from wineandtapas.com, and we will accept orders at our discretion. If an order is accepted successfully, the contract will be formed on these terms and conditions. Once an order is accepted via our formal order system both parties are deemed to have entered into a formally binding contract. All contracts will be governed by the Sales of Goods Act 1988 in place under Irish legislation.

Prices
The prices on the wineandtapas.com website are displayed inclusive of VAT. Prices are exclusive of delivery in Ireland only. All prices include VAT.

All orders are subject to availability of stock, and prices and vintages are subject to change without notice. You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Delivery charges are set out in our website.

Payment
Credit cards are the only way of payment. Payments are made through Realex Payments system however; is it not compulsive to hold a Realex Payments account to purchase products, they can be purchased using the credit card one-time off payment; this option is available in Realex Payments. Conditions and requirements to use this system should be followed to comply with Realex Payments system and to ensure that the transaction will be made in a secure way.

Stock Delays
If Wineandtapas.com does not have a particular product in stock at the time of receiving an online order that may result in a small delay in delivering the item, efforts will be made to deliver the product in a period between 2 to 5 working days

Damaged Goods and Product Returns
Secure and safe packaging is used to transport all products. In the event that any products should arrived in bad conditions or damaged is responsibility of the customer to notify wineandtapas.com. This should be done within 5 to 7 working days so that actions can be taken to inspect the damaged goods and if applicable to offer a refund or to replace the damaged merchandise.

The Buyer undertakes to verbally notify the Vendor and carrier within two working days of any claims of shortage, pilferage, breaking or other non-delivery, followed by a claim in writing within seven working days. Claims outside there terms will not be entertained. Any defective goods must be made available for inspection by the vendor, on request.

If a product is missing, the buyer should write on the missing product on the delivery slip and contact Wineandtapas.com within 48 hours. If a wrong order has been received, the price of the order will be refunded

Customer Queries & Complaints
Efforts will be made by Wineandtapas.com to respond customer complaints in a timely manner. (Within 7 working days)

Delivery
Deliveries will only take place in the Republic of Ireland. We will attempt to deliver the product between 2 to 5 working days. In unforeseen circumstances the time of the delivery may extend to a seven days period. While attempts will be made to guarantee delivery will be made within a reasonable time from your time of order, contractual obligations will not be affected by the delay. During peak times there may be some extra delay due to our carriers being overburdened; this is not deemed to be the responsibility of wineandtapas.com and wineandtapas.com hold no responsibility for any delays.

Accuracy of graphical images and pictures
Wineandtapas.com is not responsible for any variations in colour or shape from the photographs shown in the website (jpeg) to the real physical products that may happen in some situation. Images are only use for approximate descriptions and try to be as accurate as possible. In order to assist the buyer a text description will be available, the same as when more than one item is displayed to clarify that it corresponds to the purchase of one product only. In some circumstances props may be used to advertise the product but the item will be sold alone as those items are not part of it.

Unforeseen circumstances
When due to unforeseen circumstances, wineandtapas.com is unable to deliver the product, the website will reserve the right to cancel the contract and refund all the money paid via Credit Card. Once wineandtapas.com is sure that the order can be delivered credit cards will only be debited. Refunds, depending on the card issuer via Realex Payments could take up to 30 days for the funds to show in the credit card statement.

Collation of Information & its use:
The Privacy Statement of this website must be read carefully. Required information such as Cardholder Name and address (not stored by wineandtapas.com), delivery address, customer email, credit card number (not stored by wineandtapas.com), order quantities and product descriptions is use solely for transaction purposes.

When you place orders or access your account information, we may offer the use of a secure server. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, all the customer data we collect is protected against unauthorized access.

The contract between the parties is to be governed by and construed according to Irish law and the Irish courts shall have jurisdiction to resolve any disputes between us.
